Muwatta Malik 1512
حَدَّثَنِي مَالِكٌ، عَنْ نَافِعٍ، أَنَّ صَفِيَّةَ بِنْتَ أَبِي عُبَيْدٍ، أَخْبَرَتْهُ أَنَّ أَبَا بَكْرٍ الصِّدِّيقَ أُتِيَ بِرَجُلٍ قَدْ وَقَعَ عَلَى جَارِيَةٍ بِكْرٍ فَأَحْبَلَهَا ثُمَّ اعْتَرَفَ عَلَى نَفْسِهِ بِالزِّنَا وَلَمْ يَكُنْ أَحْصَنَ فَأَمَرَ بِهِ أَبُو بَكْرٍ فَجُلِدَ الْحَدَّ ثُمَّ نُفِيَ إِلَى فَدَكَ .
Traduction
Nafe' a rapporté que Safia Bint Abi Oubaid lui a raconté qu'un homme qui avait commit l'adultère avec une femme, et elle tomba enceinte, fut amené chez Abou Bakr Al-Siddiq. Elle confesa d'avoir commis l'adultère, et n'étant pas marié, Abou Bakr ordonna de soumettre l'homme à la peine prescrite, puis l'exila à Fadak». - Concernant celui qui se confesse d'avoir commis l'adultère, puis revient sur ses dires, en disant: «Je ne l'ai pas commis, mais j'ai cru avoir commis une chose pareille, qu'il cite», Malek a dit: «On accepte sa réaction, et l'on ne le soumet pas à la peine prescrite, car la peine n'est à appliquer que dans deux cas ou qu'une preuve soit évidente, et condamne par le fait même son auteur, ou qu'une confession soit faite, et on le soumet alors à la peine prescrite». - Malek a dit: «Ce qui a été parvenu des hommes versés dans la religion, c'est que les esclaves ne sont plus à exiler, au cas où ils ont commis l'adultère».
