Muwatta Malik 1510
وَحَدَّثَنِي مَالِكٌ، أَنَّهُ بَلَغَهُ أَنَّ عُثْمَانَ بْنَ عَفَّانَ، أُتِيَ بِامْرَأَةٍ قَدْ وَلَدَتْ فِي سِتَّةِ أَشْهُرٍ فَأَمَرَ بِهَا أَنْ تُرْجَمَ فَقَالَ عَلِيُّ بْنُ أَبِي طَالِبٍ لَيْسَ ذَلِكَ عَلَيْهَا إِنَّ اللَّهَ تَبَارَكَ وَتَعَالَى يَقُولُ فِي كِتَابِهِ {وَحَمْلُهُ وَفِصَالُهُ ثَلاَثُونَ شَهْرًا} وَقَالَ {وَالْوَالِدَاتُ يُرْضِعْنَ أَوْلاَدَهُنَّ حَوْلَيْنِ كَامِلَيْنِ لِمَنْ أَرَادَ أَنْ يُتِمَّ الرَّضَاعَةَ} فَالْحَمْلُ يَكُونُ سِتَّةَ أَشْهُرٍ فَلاَ رَجْمَ عَلَيْهَا . فَبَعَثَ عُثْمَانُ بْنُ عَفَّانَ فِي أَثَرِهَا فَوَجَدَهَا قَدْ رُجِمَتْ .
Traduction
On rapporta à Malek qu'une femme, avait accouché après six mois et fut amenée chez Osman Ibn Affan, il ordonna qu'on la lapide. Or Ali Ibn Abi Taleb lui dit: «On ne doit pas la soumettre aux peines prescrites, car Allah Béni et Très-Haut a dit (le sens): «Depuis le moment où elle l'a conçu jusqu'à l'époque de son sevrage, trente mois se sont écoulés» (Coran XLVI verset 15), et (le sens) «Les mères qui veulent donner à leurs enfants un allaitement complet, les allaiteront deux année entières» (Coran II verset 233). Ainsi la grossesse, étant de six mois, elle n'est pas à lapider. Osman se mit à la recherche de la femme, et trouva qu'elle avait été lapidée».
