Muwatta Malik 1511
حَدَّثَنِي مَالِكٌ، عَنْ زَيْدِ بْنِ أَسْلَمَ، أَنَّ رَجُلاً، اعْتَرَفَ عَلَى نَفْسِهِ بِالزِّنَا عَلَى عَهْدِ رَسُولِ اللَّهِ صلى الله عليه وسلم فَدَعَا لَهُ رَسُولُ اللَّهِ صلى الله عليه وسلم بِسَوْطٍ فَأُتِيَ بِسَوْطٍ مَكْسُورٍ فَقَالَ " فَوْقَ هَذَا " . فَأُتِيَ بِسَوْطٍ جَدِيدٍ لَمْ تُقْطَعْ ثَمَرَتُهُ فَقَالَ " دُونَ هَذَا " . فَأُتِيَ بِسَوْطٍ قَدْ رُكِبَ بِهِ وَلاَنَ فَأَمَرَ بِهِ رَسُولُ اللَّهِ صلى الله عليه وسلم فَجُلِدَ ثُمَّ قَالَ " أَيُّهَا النَّاسُ قَدْ آنَ لَكُمْ أَنْ تَنْتَهُوا عَنْ حُدُودِ اللَّهِ مَنْ أَصَابَ مِنْ هَذِهِ الْقَاذُورَاتِ شَيْئًا فَلْيَسْتَتِرْ بِسِتْرِ اللَّهِ فَإِنَّهُ مَنْ يُبْدِي لَنَا صَفْحَتَهُ نُقِمْ عَلَيْهِ كِتَابَ اللَّهِ " .
Traduction
Zaid Ibn Aslam a rapporté, qu'au temps de l'Envoyé d'Allah r (salallahou alayhi wa salam) (Sur lui la grâce et la paix d'Allah) un homme s'est confessé d'avoir commis l'adultère.L'Envoyé d'Allah r (salallahou alayhi wa salam) (Sur lui la grâce et la paix d'Allah) demanda qu'on lui apporte un fouet. On lui apporta un fouet brisé, il dit: «Que le fouet soit plus long». Ainsi, ou lui apporta un fouet neuf qui avait le extrémités encore dures». «Un autre moins dur que celui-ci, dit l'Envoyé d'Allah r (salallahou alayhi wa salam) (Sur lui la grâce et la paix d'Allah)». On lui apporta un fouet convenable, il ordonna que l'homme soit fouetté, puis il dit: «Hommes! Il est déjà temps que vous observiez les peines prescrites par Allah. Que celui qui commet un tel ignoble crime, qu'il se cache par le voile d'Allah. Et quiconque ainsi celui qui nous fait savoir qu'il l'a commis, nous le soumettrons à la peine, selon Le Livre d'Allah»
