Muwatta Malik 1508
حَدَّثَنِي مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ، عَنْ أَبِي وَاقِدٍ اللَّيْثِيِّ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ، أَتَاهُ رَجُلٌ وَهُوَ بِالشَّامِ فَذَكَرَ لَهُ أَنَّهُ وَجَدَ مَعَ امْرَأَتِهِ رَجُلاً فَبَعَثَ عُمَرُ بْنُ الْخَطَّابِ أَبَا وَاقِدٍ اللَّيْثِيَّ إِلَى امْرَأَتِهِ يَسْأَلُهَا عَنْ ذَلِكَ فَأَتَاهَا وَعِنْدَهَا نِسْوَةٌ حَوْلَهَا فَذَكَرَ لَهَا الَّذِي قَالَ زَوْجُهَا لِعُمَرَ بْنِ الْخَطَّابِ وَأَخْبَرَهَا أَنَّهَا لاَ تُؤْخَذُ بِقَوْلِهِ وَجَعَلَ يُلَقِّنُهَا أَشْبَاهَ ذَلِكَ لِتَنْزِعَ فَأَبَتْ أَنْ تَنْزِعَ وَتَمَّتْ عَلَى الاِعْتِرَافِ فَأَمَرَ بِهَا عُمَرُ فَرُجِمَتْ .
Traduction
Abou Waquid Al-Laithi a rapporté qu'un homme vint trouver Omar Ibn Al-Khattab, qui était au Cham (Syrie), et lui apprit avoir trouvé un homme avec sa femme. Omar Ibn Al-Khattab envoya de sa part, Abou Waqid Al-Laithi auprès de la femme pour l'interroger à ce sujet. Il fut chez elle, alors que certaines femmes s'y trouvaient, et il lui rapporta, ce que son mari avait appris à Omar. Par la suite il l'informa qu'elle ne serait pas juger sur les paroles de son mari seulement et suggéra de démentir les dires de son mari, afin qu'elle n'avoue pas son délit. Comme la femme le refusa, et avoua son délit, Omar ordonna de la lapider»
