Muwatta Malik 1420
قَالَ يَحْيَى قَالَ مَالِكٌ عَنِ ابْنِ شِهَابٍ، عَنْ سُنَيْنٍ أَبِي جَمِيلَةَ، رَجُلٌ مِنْ بَنِي سُلَيْمٍ أَنَّهُ وَجَدَ مَنْبُوذًا فِي زَمَانِ عُمَرَ بْنِ الْخَطَّابِ قَالَ فَجِئْتُ بِهِ إِلَى عُمَرَ بْنِ الْخَطَّابِ فَقَالَ مَا حَمَلَكَ عَلَى أَخْذِ هَذِهِ النَّسَمَةِ فَقَالَ وَجَدْتُهَا ضَائِعَةً فَأَخَذْتُهَا . فَقَالَ لَهُ عَرِيفُهُ يَا أَمِيرَ الْمُؤْمِنِينَ إِنَّهُ رَجُلٌ صَالِحٌ . فَقَالَ لَهُ عُمَرُ أَكَذَلِكَ قَالَ نَعَمْ . فَقَالَ عُمَرُ بْنُ الْخَطَّابِ اذْهَبْ فَهُوَ حُرٌّ وَلَكَ وَلاَؤُهُ وَعَلَيْنَا نَفَقَتُهُ .
Traduction
Ibn Chéhab a rapporté que Sounain Ibn Jamila, un homme de Bani Soulaim, a trouvé, au temps de Omar Ibn Al-Khattab, un enfant abandonné. Sounain continue: «Alors je l'ai amené chez Omar Ibn Al-Khattab qui me demanda: «Qu'est-ce qui t'a porté à te charger de cette petite âme» ? Sounain répondit: «Je l'ai trouvée, délaissée, alors je m'en occupais». L'un des conseillers de Omar lui dit: «Ô prince des croyants, c'est un homme vertueux», Omar de sa part répondit: «Le trouves-tu comme tel»? Oui, lui répondit le conseiller; ainsi Omar Ibn Al Khattab déclara: «Quitte donc, il est libre, et tu as le droit de le patronner, quant à nous, nous nous chargerons de ses dépenses». Malek a dit: «Ce qui est suivi à Médine, c'est de considérer l'enfant abandonné, libre, et aux musulmans de le patronner, tout en l'héritant et en payant pour lui, le prix du sang».
