Muwatta Malik 1410
قَالَ يَحْيَى قَالَ مَالِكٌ عَنْ هِشَامِ بْنِ عُرْوَةَ، أَنَّ عَبْدَ اللَّهِ بْنَ الزُّبَيْرِ، كَانَ يَقْضِي بِشَهَادَةِ الصِّبْيَانِ فِيمَا بَيْنَهُمْ مِنَ الْجِرَاحِ . قَالَ مَالِكٌ الأَمْرُ الْمُجْتَمَعُ عَلَيْهِ عِنْدَنَا أَنَّ شَهَادَةَ الصِّبْيَانِ تَجُوزُ فِيمَا بَيْنَهُمْ مِنَ الْجِرَاحِ وَلاَ تَجُوزُ عَلَى غَيْرِهِمْ وَإِنَّمَا تَجُوزُ شَهَادَتُهُمْ فِيمَا بَيْنَهُمْ مِنَ الْجِرَاحِ وَحْدَهَا لاَ تَجُوزُ فِي غَيْرِ ذَلِكَ إِذَا كَانَ ذَلِكَ قَبْلَ أَنْ يَتَفَرَّقُوا أَوْ يُخَبَّبُوا أَوْ يُعَلَّمُوا فَإِنِ افْتَرَقُوا فَلاَ شَهَادَةَ لَهُمْ إِلاَّ أَنْ يَكُونُوا قَدْ أَشْهَدُوا الْعُدُولَ عَلَى شَهَادَتِهِمْ قَبْلَ أَنْ يَفْتَرِقُوا .
Traduction
Hicham Ibn Ourwa a rapporté que Abdallah Ibn Al-Zouhair tenait en considération le témoignage des enfants, pour les blessures communes entre eux». Malek a dit: «Ce qui est suivi (chez nous) à Médine, c'est que le témoignage des enfants est toléré entre eux, pour des blessures qui leur sont communes, sans que ceci soit toléré pour d'autres. Ainsi, leur témoignage est toléré, pour avoir eu seulement entre eux, des blessures, et cela avant qu'ils ne se séparent, ou qu'on les trompe ou encore qu'on leur enseigne. Ainsi, s'ils se sont séparés, leur témoignage n'est plus considéré, sauf au cas où ils ont déclaré, avant de se séparer, ce dont quoi ils ont été témoins, à des gens justes».
