Muwatta Malik 1400
وَحَدَّثَنِي مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ، أَنَّ عُمَرَ بْنَ الْخَطَّابِ، اخْتَصَمَ إِلَيْهِ مُسْلِمٌ وَيَهُودِيٌّ فَرَأَى عُمَرُ أَنَّ الْحَقَّ لِلْيَهُودِيِّ فَقَضَى لَهُ فَقَالَ لَهُ الْيَهُودِيُّ وَاللَّهِ لَقَدْ قَضَيْتَ بِالْحَقِّ . فَضَرَبَهُ عُمَرُ بْنُ الْخَطَّابِ بِالدِّرَّةِ ثُمَّ قَالَ وَمَا يُدْرِيكَ فَقَالَ لَهُ الْيَهُودِيُّ إِنَّا نَجِدُ أَنَّهُ لَيْسَ قَاضٍ يَقْضِي بِالْحَقِّ إِلاَّ كَانَ عَنْ يَمِينِهِ مَلَكٌ وَعَنْ شِمَالِهِ مَلَكٌ يُسَدِّدَانِهِ وَيُوَفِّقَانِهِ لِلْحَقِّ مَادَامَ مَعَ الْحَقِّ فَإِذَا تَرَكَ الْحَقَّ عَرَجَا وَتَرَكَاهُ .
Traduction
Sa'id Ibn Al-Moussaiab a rapporté qu'un musulman et un juif, disputés entre eux, portèrent leur accusation à Omar Ibn Al-Khattab. Trouvant que le juif avait raison, Omar juga en sa faveur. Ainsi le juif s'écria: «Par Allah, tu as jugé en toute justice», Omar lui donna un coup de fouet, lui disant: «Comment le sais-tu»? Le Juif répondit: «Nous trouvons qu'aucun juge ne donne son jugement en toute justice, sans qu'il ait un ange à sa droite et un à sa gauche, qui le mettent sur la voie droite, lui accordant le succès pour la justice tant qu'il est pour la j ustice. Mais, s'il laisse la justice, ils l'abandonnent et retournent au ciel». Chapitre II Au sujet des témoignages
