Muwatta Malik 1444
وَحَدَّثَنِي مَالِكٌ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ عَبْدِ الرَّحْمَنِ بْنِ الْقَاسِمِ، أَنَّهُ سَمِعَ مَكْحُولاً الدِّمَشْقِيَّ، يَسْأَلُ الْقَاسِمَ بْنَ مُحَمَّدٍ عَنِ الْعُمْرَى، وَمَا يَقُولُ النَّاسُ فِيهَا فَقَالَ الْقَاسِمُ بْنُ مُحَمَّدٍ مَا أَدْرَكْتُ النَّاسَ إِلاَّ وَهُمْ عَلَى شُرُوطِهِمْ فِي أَمْوَالِهِمْ وَفِيمَا أُعْطُوا . قَالَ يَحْيَى سَمِعْتُ مَالِكًا يَقُولُ وَعَلَى ذَلِكَ الأَمْرُ عِنْدَنَا أَنَّ الْعُمْرَى تَرْجِعُ إِلَى الَّذِي أَعْمَرَهَا إِذَا لَمْ يَقُلْ هِيَ لَكَ وَلِعَقِبِكَ .
Traduction
Abdul Rahman Ibn Al-Kassem a rapporté qu'il a entendu Makhoul Al-Dimachki demander Al-Kassem Ibn Mouhammad au sujet de la «Oumra», et ce que disent les gens à ce propos»? Al-Kassem Ibn Mouhammad répondit: «Les gens ne cessent de se lier à leurs promesses de tout temps suivies, au sujet de leurs biens et de ce qu'ils reçoivent». - Malek a dit: «Ce que nous, suivons chez nous (à Médine), concernant la Oumra, c'est qu'elle doit revenir à son propriétaire à la mort du donataire sauf s'il a dit à ce dernier: «Elle revient à toi et à tes héritiers»
