Jami' at-Tirmidhi 1110
حَدَّثَنَا قُتَيْبَةُ، حَدَّثَنَا غُنْدَرٌ، حَدَّثَنَا سَعِيدُ بْنُ أَبِي عَرُوبَةَ، عَنْ قَتَادَةَ، عَنِ الْحَسَنِ، عَنْ سَمُرَةَ بْنِ جُنْدَبٍ، أَنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم قَالَ " أَيُّمَا امْرَأَةٍ زَوَّجَهَا وَلِيَّانِ فَهِيَ لِلأَوَّلِ مِنْهُمَا وَمَنْ بَاعَ بَيْعًا مِنْ رَجُلَيْنِ فَهُوَ لِلأَوَّلِ مِنْهُمَا " . قَالَ أَبُو عِيسَى هَذَا حَدِيثٌ حَسَنٌ . وَالْعَمَلُ عَلَى هَذَا عِنْدَ أَهْلِ الْعِلْمِ لاَ نَعْلَمُ بَيْنَهُمْ فِي ذَلِكَ اخْتِلاَفًا إِذَا زَوَّجَ أَحَدُ الْوَلِيَّيْنِ قَبْلَ الآخَرِ فَنِكَاحُ الأَوَّلِ جَائِزٌ وَنِكَاحُ الآخَرِ مَفْسُوخٌ وَإِذَا زَوَّجَا جَمِيعًا فَنِكَاحُهُمَا جَمِيعًا مَفْسُوخٌ . وَهُوَ قَوْلُ الثَّوْرِيِّ وَأَحْمَدَ وَإِسْحَاقَ .
Terjemahan
Telah menceritakan kepada kami [Qutaibah], telah menceritakan kepada kami [Ghundar] telah menceritakan kepada kami [Sa'id bin Abu 'Arubah] dari [Qatadah] dari [Al Hasan] dari [Samurah bin Jundab] bahwa Rasulullah shallallahu 'alaihi wasallam bersabda: "Wanita yang dinikahkan oleh dua wali, maka yang sah adalah nikah pertama. Barangsiapa yang menjual suatu dagangan kepada dua orang maka yang sah adalah (transaksi) yang pertama." Abu Isa berkata; "Ini merupakan hadits hasan. Para ulama mengamalkan hadits ini. Kami tidak mengetahui adanya perbedaan pendapat dalam masalah ini. Jika salah satu walinya menikahkan sebelum wali lainnya, maka nikah yang pertama boleh dan nikah yang kedua rusak. Jika keduanya menikahkan bersamaan maka kedua nikahnya adalah sama sama rusak. Ini juga merupakan pendapat Ats Tsauri, Ahmad dan Ishaq
