وَحَدَّثَنَا أَبُو بَكْرِ بْنُ أَبِي شَيْبَةَ، حَدَّثَنَا عَلِيُّ بْنُ مُسْهِرٍ، عَنِ الشَّيْبَانِيِّ، قَالَ سَأَلْتُ عَبْدَ اللَّهِ بْنَ أَبِي أَوْفَى عَنْ لُحُومِ الْحُمُرِ الأَهْلِيَّةِ، فَقَالَ أَصَابَتْنَا مَجَاعَةٌ يَوْمَ خَيْبَرَ وَنَحْنُ مَعَ رَسُولِ اللَّهِ صلى الله عليه وسلم وَقَدْ أَصَبْنَا لِلْقَوْمِ حُمُرًا خَارِجَةً مِنَ الْمَدِينَةِ فَنَحَرْنَاهَا فَإِنَّ قُدُورَنَا لَتَغْلِي إِذْ نَادَى مُنَادِي رَسُولِ اللَّهِ صلى الله عليه وسلم أَنِ اكْفَئُوا الْقُدُورَ وَلاَ تَطْعَمُوا مِنْ لُحُومِ الْحُمُرِ شَيْئًا فَقُلْتُ حَرَّمَهَا تَحْرِيمَ مَاذَا قَالَ تَحَدَّثْنَا بَيْنَنَا فَقُلْنَا حَرَّمَهَا أَلْبَتَّةَ وَحَرَّمَهَا مِنْ أَجْلِ أَنَّهَا لَمْ تُخَمَّسْ .
Traduction
Rapporté par Shaibani : « J’ai demandé à 'Abdullah ibn Abu Aufa رضي الله عنه si la chair des ânes domestiques était permise ou interdite. Il a dit : “Nous avons souffert de la faim le jour de Khaybar alors que nous étions avec le Messager d’Allah ﷺ. Nous avons trouvé des ânes domestiques à l’extérieur de Médine, nous les avons abattus et nos marmites étaient en train de bouillir quand l’annonceur du Messager d’Allah ﷺ a proclamé que les marmites devaient être renversées et que personne ne devait manger de la chair des ânes domestiques.” J’ai demandé : “Quel genre d’interdiction a-t-il prononcée ?” Il a répondu : “Nous en avons discuté entre nous. Certains ont dit que c’était interdit pour toujours, d’autres ont dit que c’était interdit parce qu’un cinquième du butin n’avait pas encore été remis au trésor public, comme la loi l’exige.” »
