Sahih Muslim 4686 — Book 32, Hadith 168

وَحَدَّثَنَا ابْنُ أَبِي عُمَرَ، حَدَّثَنَا سُفْيَانُ، عَنْ إِسْمَاعِيلَ بْنِ أُمَيَّةَ، عَنْ سَعِيدٍ الْمَقْبُرِيِّ، عَنْ يَزِيدَ بْنِ هُرْمُزَ، قَالَ كَتَبَ نَجْدَةُ بْنُ عَامِرٍ الْحَرُورِيُّ إِلَى ابْنِ عَبَّاسٍ يَسْأَلُهُ عَنِ الْعَبْدِ، وَالْمَرْأَةِ يَحْضُرَانِ الْمَغْنَمَ هَلْ يُقْسَمُ لَهُمَا وَعَنْ قَتْلِ الْوِلْدَانِ وَعَنِ الْيَتِيمِ مَتَى يَنْقَطِعُ عَنْهُ الْيُتْمُ وَعَنْ ذَوِي الْقُرْبَى مَنْ هُمْ فَقَالَ لِيَزِيدَ اكْتُبْ إِلَيْهِ فَلَوْلاَ أَنْ يَقَعَ فِي أُحْمُوقَةٍ مَا كَتَبْتُ إِلَيْهِ اكْتُبْ إِنَّكَ كَتَبْتَ تَسْأَلُنِي عَنِ الْمَرْأَةِ وَالْعَبْدِ يَحْضُرَانِ الْمَغْنَمَ هَلْ يُقْسَمُ لَهُمَا شَىْءٌ وَإِنَّهُ لَيْسَ لَهُمَا شَىْءٌ إِلاَّ أَنْ يُحْذَيَا وَكَتَبْتَ تَسْأَلُنِي عَنْ قَتْلِ الْوِلْدَانِ وَإِنَّ رَسُولَ اللَّهِ صلى الله عليه وسلم لَمْ يَقْتُلْهُمْ وَأَنْتَ فَلاَ تَقْتُلْهُمْ إِلاَّ أَنْ تَعْلَمَ مِنْهُمْ مَا عَلِمَ صَاحِبُ مُوسَى مِنَ الْغُلاَمِ الَّذِي قَتَلَهُ وَكَتَبْتَ تَسْأَلُنِي عَنِ الْيَتِيمِ مَتَى يَنْقَطِعُ عَنْهُ اسْمُ الْيُتْمِ وَإِنَّهُ لاَ يَنْقَطِعُ عَنْهُ اسْمُ الْيُتْمِ حَتَّى يَبْلُغَ وَيُؤْنَسَ مِنْهُ رُشْدٌ وَكَتَبْتَ تَسْأَلُنِي عَنْ ذَوِي الْقُرْبَى مَنْ هُمْ وَإِنَّا زَعَمْنَا أَنَّا هُمْ فَأَبَى ذَلِكَ عَلَيْنَا قَوْمُنَا ‏.‏

Traduction

Rapporté par Yazid ibn Hurmuz : Najda ibn Amir al-Haruri écrivit à Ibn Abbas pour lui demander si l’esclave et la femme recevaient une part du butin s’ils participaient au jihad ; s’il était permis de tuer les enfants ennemis pendant la guerre ; à partir de quand cesse-t-on d’être orphelin ; et qui sont les proches du Prophète ﷺ. Il dit à Yazid : « Écris-lui. (Si je ne craignais pas qu’il tombe dans l’erreur, je ne lui aurais pas répondu.) Écris : Tu m’as demandé si la femme et l’esclave reçoivent une part du butin s’ils participent au jihad. Sache qu’ils n’ont rien de ce genre, sauf qu’on leur donne une récompense. Tu m’as aussi demandé s’il est permis de tuer les enfants ennemis pendant la guerre. Sache que le Messager d’Allah ﷺ ne les tuait pas, et tu ne dois pas les tuer, sauf si tu savais ce que le compagnon de Moïse (Khadir) savait à propos du garçon qu’il a tué. Tu m’as aussi demandé à partir de quand on ne considère plus quelqu’un comme orphelin. Sache que ce terme ne s’applique plus à lui que lorsqu’il atteint la maturité physique et mentale. Enfin, tu m’as demandé qui sont les proches du Prophète ﷺ. Nous pensons que c’est nous, mais notre peuple nous a refusé ce droit et ses privilèges. »
