Muwatta Malik 1355
وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ أَبِي الزِّنَادِ، عَنْ سَعِيدِ بْنِ الْمُسَيَّبِ، أَنَّهُ كَانَ يَقُولُ نُهِيَ عَنْ بَيْعِ الْحَيَوَانِ، بِاللَّحْمِ . قَالَ أَبُو الزِّنَادِ فَقُلْتُ لِسَعِيدِ بْنِ الْمُسَيَّبِ أَرَأَيْتَ رَجُلاً اشْتَرَى شَارِفًا بِعَشَرَةِ شِيَاهٍ فَقَالَ سَعِيدٌ إِنْ كَانَ اشْتَرَاهَا لِيَنْحَرَهَا فَلاَ خَيْرَ فِي ذَلِكَ . قَالَ أَبُو الزِّنَادِ وَكُلُّ مَنْ أَدْرَكْتُ مِنَ النَّاسِ يَنْهَوْنَ عَنْ بَيْعِ الْحَيَوَانِ بِاللَّحْمِ . قَالَ أَبُو الزِّنَادِ وَكَانَ ذَلِكَ يُكْتَبُ فِي عُهُودِ الْعُمَّالِ فِي زَمَانِ أَبَانَ بْنِ عُثْمَانَ وَهِشَامِ بْنِ إِسْمَاعِيلَ يَنْهَوْنَ عَنْ ذَلِكَ .
Translation
Abou Al-Zanad a rapporté que Sa'id Ibn Al-Moussaiab disait; «On avait défendu la vente de l'animal (vivant) contre de la viande». - Abou Al-Zanad a aussi dit: «Alors je m'adressai à Sa'id Ibn Al-Moussaiab, disant: que dites-vous, au sujet d'un homme qui a acheté un chameau âgé contre dix moutons»? Sa'id de répondre: «S'il l'a acheté pour le sacrifier, il n'est pas bon». Et, ajouta Abou Al-Zanad: «Les gens que j'ais connus, ont interdit la vente de l'animal contre de la viande», et Abou-Zanad de conclure: «Et ceci avait été prescrit aux préfets, de l'époque de Aban Ibn Osman et de Hicham Ibn Ismaïl, d'interdire la vente d'un animal contre de la viande».
