Le Divorce
Muwatta Malik 1249
وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، أَنَّهُ بَلَغَهُ أَنَّ السَّائِبَ بْنَ خَبَّابٍ، تُوُفِّيَ وَإِنَّ امْرَأَتَهُ جَاءَتْ إِلَى عَبْدِ اللَّهِ بْنِ عُمَرَ فَذَكَرَتْ لَهُ وَفَاةَ زَوْجِهَا وَذَكَرَتْ لَهُ حَرْثًا لَهُمْ بِقَنَاةَ وَسَأَلَتْهُ هَلْ يَصْلُحُ لَهَا أَنْ تَبِيتَ فِيهِ فَنَهَاهَا عَنْ ذَلِكَ فَكَانَتْ تَخْرُجُ مِنَ الْمَدِينَةِ سَحَرًا فَتُصْبِحُ فِي حَرْثِهِمْ فَتَظَلُّ فِيهِ يَوْمَهَا ثُمَّ تَدْخُلُ الْمَدِينَةَ إِذَا أَمْسَتْ فَتَبِيتُ فِي بَيْتِهَا .
Traduction
Sa'id Ibn Al- Moussaiab a rapporté que Omar Ibn Al-Khattab renvoyait les femmes dont les maris étaient morts dans le désert«Al-Baida», et leur interdisait d'accomplir le pèlerinage». (. . ) 98 - Yahia Ibn Sa'id a rapporté qu'on lui fit apprendre que Al-Saib Ibn Khabbab mourut, et sa femme vint auprès de Abdallah Ibn Omar lui dire que son mari était mort, lui laissant un terrain cultivé à «Qanate», et lui demanda s'il etait convenable d'y séjourner ? Comme Abdallah le lui interdit, elle quitta la Médine le avant l'aube, pour être de bon matin à ce terrain, et resta jusqu'au soir, temps où elle rentrait à Médine, pour passer la nuit dans sa maison»
