Muwatta Malik 1246
وَحَدَّثَنِي عَنْ مَالِكٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، عَنْ سُلَيْمَانَ بْنِ يَسَارٍ، أَنَّ عَبْدَ اللَّهِ بْنَ عَبَّاسٍ، وَأَبَا، سَلَمَةَ بْنَ عَبْدِ الرَّحْمَنِ بْنِ عَوْفٍ اخْتَلَفَا فِي الْمَرْأَةِ تُنْفَسُ بَعْدَ وَفَاةِ زَوْجِهَا بِلَيَالٍ فَقَالَ أَبُو سَلَمَةَ إِذَا وَضَعَتْ مَا فِي بَطْنِهَا فَقَدْ حَلَّتْ . وَقَالَ ابْنُ عَبَّاسٍ آخِرَ الأَجَلَيْنِ . فَجَاءَ أَبُو هُرَيْرَةَ فَقَالَ أَنَا مَعَ ابْنِ أَخِي . يَعْنِي أَبَا سَلَمَةَ فَبَعَثُوا كُرَيْبًا مَوْلَى عَبْدِ اللَّهِ بْنِ عَبَّاسٍ إِلَى أُمِّ سَلَمَةَ زَوْجِ النَّبِيِّ صلى الله عليه وسلم يَسْأَلُهَا عَنْ ذَلِكَ فَجَاءَهُمْ فَأَخْبَرَهُمْ أَنَّهَا قَالَتْ وَلَدَتْ سُبَيْعَةُ الأَسْلَمِيَّةُ بَعْدَ وَفَاةِ زَوْجِهَا بِلَيَالٍ فَذَكَرَتْ ذَلِكَ لِرَسُولِ اللَّهِ صلى الله عليه وسلم فَقَالَ " قَدْ حَلَلْتِ فَانْكِحِي مَنْ شِئْتِ " .
Traduction
Soulaiman Ibn Yassar a rapporté que Abdallah Ibn Abbas et Abou Salama Ibn Abdul Rahman se disputèrent sur le cas de la femme qui accouche quelques jours après la mort de son mari. Ainsi, Abou Salama dit: «Si elle accouche, elle pourra se remarier», et Ibn Abbas dit: «Elle a à fixer la période d'attente la plus longue (c.f. 1250-92). Arrivant, Abou Houraira dit: «Moi, j'approuve, le fils de mon frère désignant Abou Salama. Cela fait, ils envoyèrent Kouraib, l'esclave de Abdallah Ibn Abbas auprès de Oum Salama, la femme du Prophète r (Sur lui la grâce et la paix d'Allah) et lui demanda à ce sujet. Kouraib revint et leur rapporta qu'elle avait dit: «Soubai'a avait accouché quelques jours après la mort de son mari. Elle demanda à l'Envoyé d'Allah (salallahou alayhi wa salam) (Sur lui la grâce et la paix d'Allah) à ce sujet, il lui répondit: «Tu pourras te marier d'avec celui que tu voudras.
