Muwatta Malik 1241
وَحَدَّثَنِي عَنْ مَالِكٍ، أَنَّهُ بَلَغَهُ أَنَّ سَعِيدَ بْنَ الْمُسَيَّبِ، وَسُلَيْمَانَ بْنَ يَسَارٍ، سُئِلاَ عَنْ طَلاَقِ السَّكْرَانِ، فَقَالاَ إِذَا طَلَّقَ السَّكْرَانُ جَازَ طَلاَقُهُ وَإِنْ قَتَلَ قُتِلَ بِهِ . قَالَ مَالِكٌ وَعَلَى ذَلِكَ الأَمْرُ عِنْدَنَا .
Traduction
On rapporta à Malek, que Sa'id Ibn Al Moussaiab et Soulaiman Ibn Yassar ont été questionnés au sujet d'un ivrogne qui divorce d'avec sa femme. Ils répondirent: «Si un ivrogne divorce d'avec sa femme, son divorce est à considérer, s'il tue il sera tué». Malek a dit: «Et telle est la règle que l'on suit parmi nous». (.....) 91 - On rapporta à Malek que Sa'id Ibn Al Moussaiab disait: «Si l'homme ne trouve pas de quoi dépenser pour sa femme, on séparera entre eux».
