وَحَدَّثَنِي عَنْ مَالِكٍ، أَنَّهُ بَلَغَهُ أَنَّ عَبْدَ اللَّهِ بْنَ مَسْعُودٍ، كَانَ يَقُولُ فِيمَنْ قَالَ كُلُّ امْرَأَةٍ أَنْكِحُهَا فَهِيَ طَالِقٌ إِنَّهُ إِذَا لَمْ يُسَمِّ قَبِيلَةً أَوِ امْرَأَةً بِعَيْنِهَا فَلاَ شَىْءَ عَلَيْهِ ‏.‏ قَالَ مَالِكٌ وَهَذَا أَحْسَنُ مَا سَمِعْتُ ‏.‏ قَالَ مَالِكٌ فِي الرَّجُلِ يَقُولُ لاِمْرَأَتِهِ أَنْتِ الطَّلاَقُ وَكُلُّ امْرَأَةٍ أَنْكِحُهَا فَهِيَ طَالِقٌ وَمَالُهُ صَدَقَةٌ إِنْ لَمْ يَفْعَلْ كَذَا وَكَذَا فَحَنِثَ قَالَ أَمَّا نِسَاؤُهُ فَطَلاَقٌ كَمَا قَالَ وَأَمَّا قَوْلُهُ كُلُّ امْرَأَةٍ أَنْكِحُهَا فَهِيَ طَالِقٌ فَإِنَّهُ إِذَا لَمْ يُسَمِّ امْرَأَةً بِعَيْنِهَا أَوْ قَبِيلَةً أَوْ أَرْضًا أَوْ نَحْوَ هَذَا فَلَيْسَ يَلْزَمُهُ ذَلِكَ وَلْيَتَزَوَّجْ مَا شَاءَ وَأَمَّا مَالُهُ فَلْيَتَصَدَّقْ بِثُلُثِهِ ‏.‏

Traduction

On rapporta à Malek que Omar Ibn Al-Khattab, Abdallah Ibn Omar, Abdallah Ibn Mass'oud, Salem Ibn Abdallah, Al-Kassem Ibn Mouhammad, Ibn Chéhab, et Soulaiman Ibn Yassar disaient: «Si un homme a fait serment de divorcer d'une femme avant qu'il n'y ait mariage puis démentit son serment, il faut qu'il la divorce s'il l'a déjà marié». (.....) 81 - On rapporta à Malek que Abdallah Ibn Mass'oud disait: «Pour celui qui dit: «Toute femme d'avec qui je me marierai, est divorcée, s'il n'a désigné ni le nom de la tribu, ni celui de la femme, son serment n'est pas à considérer». - Malek a dit: «C'est ce que j'ai entendu de mieux». - Malek a finalement dit: «Concernant l'homme qui dit à sa femme: «Tu es divorcée, aussi bien que celles avec qui je me marierai», et qui dit encore:«Tous mes biens seront une aumône si je ne fais pas telle ou telle chose», puis qu'il revienne sur son serment, son cas sera ce qui suit: «Pour ses femmes, elles sont certainement divorcées, quant aux autres femmes dont ni nom, ni tribu, ni pays n'ont été précisés, son serment à leur égard est invalable. Et pour ses biens, il devra faire aumône du tiers». Chapitre XXVIII Le délai que l'on accorde à l'homme qui n'a pas touché sa femme
