Muwatta Malik 1125
وَحَدَّثَنِي عَنْ مَالِكٍ، عَنِ ابْنِ شِهَابٍ، عَنْ قَبِيصَةَ بْنِ ذُؤَيْبٍ، أَنَّ رَجُلاً، سَأَلَ عُثْمَانَ بْنَ عَفَّانَ عَنِ الأُخْتَيْنِ، مِنْ مِلْكِ الْيَمِينِ هَلْ يُجْمَعُ بَيْنَهُمَا فَقَالَ عُثْمَانُ أَحَلَّتْهُمَا آيَةٌ وَحَرَّمَتْهُمَا آيَةٌ فَأَمَّا أَنَا فَلاَ أُحِبُّ أَنْ أَصْنَعَ ذَلِكَ . قَالَ فَخَرَجَ مِنْ عِنْدِهِ فَلَقِيَ رَجُلاً مِنْ أَصْحَابِ رَسُولِ اللَّهِ صلى الله عليه وسلم فَسَأَلَهُ عَنْ ذَلِكَ فَقَالَ لَوْ كَانَ لِي مِنَ الأَمْرِ شَىْءٌ ثُمَّ وَجَدْتُ أَحَدًا فَعَلَ ذَلِكَ لَجَعَلْتُهُ نَكَالاً . قَالَ ابْنُ شِهَابٍ أُرَاهُ عَلِيَّ بْنَ أَبِي طَالِبٍ .
Translation
Kabissa Ibn Zouaib a rapporté qu'un homme avait demandé Osman Ibn Affan au sujet de deux sœurs, captives de guerre, peut-on les avoir ensemble, toutes deux pour femmes»? Osman répondit: «Un verset l'autorise, un autre l'interdit. Quant à moi, je repousse ce faire». Remarque: Le verset qui autorise, et l'autre qui interdit sont successivement: «Les femmes de bonne condition à moins qu'elles ne soient captives de guerre» Coran IV, 24. Et «Il vous est encore interdit deux sœurs réunies…» Coran IV, 23. Malek continua: «L'homme sortit de chez Osman, et rencontra un des compagnons de l'Envoyé d'Allah r (salallahou alayhi wa salam) (Sur lui la grâce et la paix d'Allah) à qui il demanda sur le même sujet. Il lui répondit: «Si cette affaire me revient en personne, et que j'ai trouvé quelqu'un faire cela, j'aurais dû faire de lui en exemple (à ne pas être imité des autres, et à le châtier). Ibn Chéhab ajouta: «Je pense que ce compagnon-ci, était Ali Ibn Abi-Taleb»
