Muwatta Malik 1113
وَحَدَّثَنِي يَحْيَى، عَنْ مَالِكٍ، عَنْ يَحْيَى بْنِ سَعِيدٍ، أَنَّهُ قَالَ سُئِلَ زَيْدُ بْنُ ثَابِتٍ عَنْ رَجُلٍ، تَزَوَّجَ امْرَأَةً ثُمَّ فَارَقَهَا قَبْلَ أَنْ يُصِيبَهَا هَلْ تَحِلُّ لَهُ أُمُّهَا فَقَالَ زَيْدُ بْنُ ثَابِتٍ لاَ الأُمُّ مُبْهَمَةٌ لَيْسَ فِيهَا شَرْطٌ وَإِنَّمَا الشَّرْطُ فِي الرَّبَائِبِ .
Translation
Yahia Ibn Sa'id a rapporté qu'on demanda Zaid Ibn thabet au sujet d'un homme qui s'est marié d'une femme, puis la quitta avant qu'il n'ait eu avec elle des rapports charnels, pourra-t-il épouser sa mère»? Zaid Ibn Thabet répondit: «Non, car la mère est sujet équivoque, à titre de qui, on n'a trouvé aucune explication qui soit claire, par opposition au cas des belles filles placées sous sa tutelle»
